Durable Power of Attorney

Most people know that a Last Will & Testament is an important part of estate planning, but a lot of people do not know about a critical set of documents called (1) Durable Power of Attorney for Financial Management, and (2) Durable Power of Attorney for Health Care. These documents allow you to designate another person as your Agent to keep your life running or make health care decisions for you when you are incapacitated and unable to do these things for yourself. A Durable Power of Attorney for Financial Management gives your Financial Agent the authority they need to do things like make mortgage payments, access your bank account, cancel your phone plan, and even buy or sell property. A Durable Power of Attorney for Health Care gives your Health Care Agent the authority to make health care decisions for you. Generally, your Agent under a Durable Power of Attorney document can do everything you are able to do. Please note, however, that by designating another person as your Agent you are not giving away your ability to make your own decisions or to maintain control of your life - you are authorizing another person to step in if and when such action is necessary.
