What is a guardianship?

Guardianship is a legal arrangement where an individual is appointed to make decisions for an adult who is unable to manage their own affairs. In the state of Washington, a guardian is someone who helps an incapacitated person manage their health, safety, and self-care. A conservator helps an incapacitated person make financial decisions about their money and property. Some people need both a guardianship and conservatorship, while others need only one.

What are examples of when someone needs a guardian?

There are many reasons why an adult would be in need of a guardian. In some cases, a person is diagnosed with a mental illness, such as schizophrenia or dementia, that is preventing them from being able to take care of themselves. At other times, a guardianship may be considered if a child who demonstrates incapacity is turning 18 and their parents need a continued ability to make decisions on behalf of their child. Thus, it is a case-by-case basis and there is a thorough legal process to ensure that guardianships or conservatorships are working in the best interest of the person being considered.
